1. Parties
These General Terms of Service have been drawn up between BayPro Yazılım ("BayPro" or the "Company") and the natural or legal persons receiving the services offered by BayPro (the "Customer"). BayPro, located at Künhan Plaza A/6, Nilüfer / Bursa, will provide services within the framework of these terms.
2. Entry into Force of the Agreement
The agreement enters into force when the Customer applies to receive services through BayPro's website or by other means. The agreement remains valid for as long as the Customer receives services.
3. Provision of Services
BayPro undertakes to provide the services as long as the terms set out in the agreement are complied with. However, the Company does not guarantee that the services it offers will fully meet all of the Customer's needs or that the service will be error-free and uninterrupted. Temporary service interruptions may occur due to planned maintenance and urgent security updates.
4. Obligations of the Customer
While using the services, the Customer agrees to comply with the following rules:
- Not to send spam (unsolicited bulk e-mail) through the services
- Not to distribute or share copyright-protected content without permission
- Not to attempt unauthorised access to systems (hacking)
- Not to share or publish content contrary to public morals and decency
- Not to engage in threatening, harassing or harmful behaviour
- Not to carry out transactions contrary to the laws of the Republic of Türkiye and the relevant international regulations
- Not to engage in activities that infringe the rights of third parties
5. Payment Terms
Service fees are determined according to the selected package and service type. For services offered under a subscription model, payment is collected in advance for the specified billing periods (monthly or yearly). Payments can be made by credit card, bank transfer/EFT or other methods accepted by BayPro.
6. Refunds and Money-Back Guarantee
New customers are offered a 7-day unconditional full money-back guarantee from the date of first purchase. Customers who wish to cancel the service within this period can get back the full amount they paid. Certain special services (customised software development projects, domain registration, etc.) may be excluded from the scope of this guarantee.
7. Termination of the Agreement
The Customer may terminate the agreement without stating any reason by giving written notice (e-mail, post or fax) 5 business days in advance. BayPro also has the right to terminate the agreement unilaterally if it detects a breach of these terms, late payment or unlawful use.
8. Limitation of Liability
BayPro cannot be held liable for any direct or indirect damages, data loss or loss of business that may arise from the use of the service. In any event, BayPro's liability is limited to the service fee paid for that month.
9. Changes
BayPro reserves the right to update these terms from time to time. Significant changes will be notified to the Customer by e-mail. Continuing to use the service after the notification means accepting the updated terms.
10. Dispute Resolution
The Courts and Enforcement Offices of Bursa have jurisdiction over disputes arising from this agreement. The parties agree to negotiate in good faith before bringing a dispute to litigation.
